Terms of Service

1. Acceptance of Terms

By accessing or using Zen Books ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Zen Books is a cloud-based accounting platform designed for small and medium businesses in Southern Africa. The Service includes invoicing, expense tracking, inventory management, financial reporting, point of sale, and related features.

3. Account Registration

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account.

4. Subscription Plans

• Starter (Free) — basic features, 1 user, no expiry.
• Business — expanded features, up to 5 users, paid monthly.
• Enterprise — full features, unlimited users, paid monthly.

Paid plans are billed in advance. Prices are in Eswatini Lilangeni (SZL) unless otherwise stated. We reserve the right to change pricing with 30 days' notice.

5. Payment

Payments are processed via MTN Mobile Money. By making a payment, you authorise the charge to your mobile money account. Failed payments may result in service interruption after the grace period.

6. Your Data

You retain ownership of all data you enter into the Service. We do not claim any intellectual property rights over your business data. You grant us a limited licence to store, process, and display your data solely for the purpose of providing the Service.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorised access to other users' data
• Upload malicious files or code
• Resell or redistribute the Service without permission
• Use the Service to store or transmit content that infringes on others' rights

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We will provide reasonable notice for planned maintenance where possible.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages.
• Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
• We are not responsible for decisions made based on data or reports generated by the Service.

10. Termination

You may terminate your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained according to our Data Retention Policy.

11. Governing Law

These Terms are governed by the laws of the Kingdom of Eswatini. Any disputes shall be resolved in the courts of Eswatini.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
